By using AI Portrait Studio, you agree to these Terms. The app uses BytePlus Seedream AI to transform your selfie into styled portraits. Purchases include one-time credit packs and auto-renewing subscriptions, all processed by Apple. This agreement includes required Apple EULA provisions.
1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User") and HONGKONG HDTP SOFTWARE LIMITED ("we", "us", "Company") governing your use of AI Portrait Studio (the "App").
By downloading, installing, or using the App, you confirm you have read, understood, and agree to these Terms and our Privacy Policy. If you do not agree, do not use the App.
2. Service Description
AI Portrait Studio is an AI-powered photo generation app that transforms your selfie photos into styled portrait images using BytePlus Seedream 4.5 (ByteDance International) AI technology. The App offers multiple aesthetic styles and requires an internet connection for AI generation.
3. User Requirements
- You must be at least 13 years old to use the App
- You must only upload photos of yourself or photos you have legal rights to use
- You must not upload photos of other people without their explicit consent
- You must not use the App to create harmful, illegal, or inappropriate content
- You are responsible for ensuring your use complies with applicable laws in your jurisdiction
4. AI-Generated Content
Important: All images generated by this App are created by artificial intelligence. Generated images are artistic interpretations and may not perfectly represent real-world appearances. AI-generated content is marked with a subtle identifier for transparency.
- Generated images are AI creations and may contain imperfections or unexpected results
- We do not guarantee specific results or exact likeness
- You own the generated images for personal use
- You may share generated images on social media for personal, non-commercial purposes
- You may not use generated images for fraudulent purposes, identity theft, or to deceive others
- You may not use generated images to create deepfakes or non-consensual intimate content
- AI-generated images must not be used for identity verification or official documentation
5. Credits & Payments
- Free trial: Each device receives one free generation (3 photos) as a trial
- Credit packs: One-time purchases that never expire
- Subscriptions: Monthly and yearly plans with credits allocated each billing period
- All purchases are processed through Apple's App Store — we do not handle payment data
- Subscription credits reset each billing period and do not roll over
- Purchases are final and non-refundable except as required by applicable law

6. Subscription Terms
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
- Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period
- Manage and cancel subscriptions: iPhone Settings → Apple ID → Subscriptions
- Any unused portion of a free trial period will be forfeited upon purchasing a subscription
- Price changes will be communicated in advance through the App Store
7. Intellectual Property
- The App, its design, features, and technology are owned by HONGKONG HDTP SOFTWARE LIMITED
- The aesthetic styles, prompts, and associated artwork are our intellectual property
- You retain rights to your original selfie photos
- You receive a personal, non-transferable, non-exclusive licence to use generated images for personal purposes
8. Prohibited Uses
You may not:
- Reverse engineer, decompile, or disassemble the App
- Attempt to bypass free trial limits or payment systems
- Use automated tools, bots, or scripts to access the service
- Upload illegal, harmful, or inappropriate content
- Use generated images for commercial purposes without prior written consent
- Use the App in any way that violates applicable laws or regulations
- Impersonate others using AI-generated portraits
9. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee uninterrupted service, specific image quality, or compatibility with all devices.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HONGKONG HDTP SOFTWARE LIMITED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO LOSS OF CREDITS, DATA, OR GENERATED IMAGES.
Our total aggregate liability shall not exceed the amount you paid for in-app purchases in the twelve months preceding the claim.
11. Termination
We reserve the right to terminate or suspend your access to the App at any time if you breach these Terms. Upon termination, you must cease all use and delete the App. Sections 7, 9, 10, and 12 survive termination.
12. Governing Law
These Terms are governed by the laws of the Hong Kong Special Administrative Region. Any disputes shall be subject to the exclusive jurisdiction of the courts of Hong Kong SAR.
13. Apple EULA Provisions
Required Apple App Store Disclosures
- Parties: This EULA is between you and HONGKONG HDTP SOFTWARE LIMITED, not Apple Inc. Apple is not a party to this agreement and has no responsibility for the App or its content.
- Licence Scope: Use is limited to Apple-branded devices you own or control, per App Store Usage Rules.
- Maintenance & Support: HONGKONG HDTP SOFTWARE LIMITED, not Apple, provides all support. Contact sales@hkhdtp.com.
- Warranty: In case of warranty failure, you may notify Apple for a purchase price refund (if any). Apple has no further warranty obligation.
- Product Claims: HONGKONG HDTP SOFTWARE LIMITED is responsible for all product-related claims. Apple has no responsibility.
- Third-Party Beneficiary: Apple and its subsidiaries are third-party beneficiaries of this EULA and may enforce it against you.
14. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be notified via an updated "Last Updated" date and, where appropriate, an in-app notice. Continued use of the App after changes take effect constitutes acceptance.
