📋 Summary. By using PhotoRestore, you agree to these Terms. The app uses Sign in with Apple, offers one-time credit packs and subscriptions. Uploaded content must comply with our content policy — violations result in immediate termination. These Terms include required Apple EULA provisions.

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and HONGKONG HDTP SOFTWARE LIMITED ("we", "us") governing your use of PhotoRestore (the "Service"). By using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Service Description

PhotoRestore is a mobile application that uses artificial intelligence to restore and enhance digital photographs. The Service is powered by Cloudflare Workers, Google Gemini API, and Replicate AI models for cloud-based processing.

3. Account Registration

You must sign in with Apple to use the Service. You are responsible for maintaining the security of your Apple ID, all activities that occur under your account, and providing accurate information. You must be at least 13 years old to use this Service.

4. Prohibited Content

⛔ You MUST NOT upload, process, or distribute content that:

Contains pornography, nudity, or sexually explicit material
Depicts or sexualizes minors in any way (CSAM)
Shows graphic violence, gore, or serious injury
Promotes terrorism, extremism, or political violence
Contains hate speech, racism, or discrimination based on protected characteristics
Violates copyright, trademark, or other intellectual property rights
Contains illegal substances, weapons, or activities
Impersonates others or facilitates fraud or deception
Contains personal information of others without their consent
Violates any applicable law or regulation

Violations may result in immediate termination of service without refund. We reserve the right to refuse service to anyone for any reason.

5. Content Ownership & Licence

You retain ownership of all photos you upload. By uploading content, you grant us a limited licence to:

Process the content using AI services to provide the restoration feature
Store the content temporarily for delivery
Use anonymised, aggregated processing data to improve the Service

We do not claim ownership of your content, will not use it for advertising, and will not share it with third parties without your consent (except as required for AI processing — see the Privacy Policy).

6. In-App Purchases & Subscriptions

Credits

One-time credit packs never expire
Subscription credits reset every 30 days (your billing cycle) and do not roll over
Credits have no cash value and cannot be transferred

Subscriptions

Subscriptions auto-renew unless cancelled at least 24 hours before the renewal date. Manage and cancel subscriptions: iPhone Settings → Apple ID → Subscriptions.

Refunds

All purchases are processed by Apple and subject to Apple's refund policies. We cannot directly issue refunds. For refund requests, visit reportaproblem.apple.com.

7. AI Processing Disclaimer

You understand and agree that:

AI processing results are not guaranteed
Quality depends on input image quality and content
Some images may not produce satisfactory results
Credits are consumed when processing starts, but refunded if processing fails due to technical errors
Credits are NOT refunded for subjective dissatisfaction with results

8. User Conduct

You agree not to:

Use the Service for any unlawful purpose
Attempt to reverse engineer or hack the Service
Use automated tools to access the Service
Resell or commercialise Credits without permission
Create multiple accounts to abuse free credits
Upload content that violates Section 4 (Prohibited Content)

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee uninterrupted or error-free service.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES. Our total liability is limited to the amount you paid us in the past 12 months.

11. Termination

We may terminate or suspend your access for violation of these Terms, uploading prohibited content, fraud or abuse, or failure to pay fees. You may terminate your account at any time by deleting the app and revoking Apple Sign In access.

12. Apple EULA Provisions

REQUIRED APPLE APP STORE DISCLOSURES

Parties: This agreement is between you and HONGKONG HDTP SOFTWARE LIMITED, not Apple Inc. Apple is not a party to this agreement and has no responsibility for the Service.
Licence Scope: Use is limited to Apple-branded devices you own or control, per App Store Usage Rules.
Maintenance & Support: Provided by HONGKONG HDTP SOFTWARE LIMITED, not Apple. Contact sales3@hkhdtp.com.
Warranty: In case of warranty failure, notify Apple for a refund (if any). Apple has no further warranty obligation.
Product Claims: HONGKONG HDTP SOFTWARE LIMITED is responsible for all product claims; Apple has no responsibility.
Third-Party Beneficiary: Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

13. Governing Law

These Terms are governed by the laws of the Hong Kong Special Administrative Region. Any disputes will be resolved in the courts of Hong Kong SAR.
